Kentucky courts generally categorize “slip and fall” incidents as those involving inclimate weather, man-made hazards and/or hazardous substances. There are a variety of other ways by which someone can be injured on the premises of a landowner or business. It is important to know the exact mechanism of injury, any and all parties who may be responsible (which may include others outside the owner/business) and understand what legal options you have. The preservation of surveillance is often important but not timely done by the at-fault parties. Gambrel & Wilder has litigated such cases to the Kentucky Supreme Court and can assist in any premises liability evaluation. Time is of the essence in order to obtain necessary photographs, video surveillance and/or retain experts to evaluate the conditions that led to injury.
